California Public Employees: What Prop 37 Means for Buying a New Home

By Chris Kobz, Founder, HappyDog

California public employees… Prop 37 passed. If you’ve been trying to save 20% down on a teacher’s or a deputy’s paycheck in this state, this one’s worth a few minutes.

I’ll keep it simple. What Prop 37 does, who it’s for, the catch, and what I’d do while we wait on the details. One thing up front… Prop 37 is run by CalHFA, the state’s housing finance agency. CELP isn’t part of it. We’re a mortgage program for public employees, and we’ll help you figure out how it fits.

What is Prop 37 in California?

Prop 37 lets CalHFA sell up to $25 billion in bonds and lend that money to home buyers as a second mortgage. The loan can cover up to 17% of the price.

You bring at least 3%. Prop 37 covers up to 17%. That’s 20% toward your home.

3+17=20: you put down at least 3%, a Prop 37 loan covers up to 17% of the price, which adds up to 20%. Your first mortgage could start at 80%.

Why does 20% matter? On paper, your first mortgage could start at 80% of the price, and that’s usually where mortgage insurance goes away. The final terms aren’t out yet, so we’ll see. But on a California price, that could make a real difference in your monthly payment.

It’s a loan, not a grant. You pay it back. It’s fixed-rate, the measure says no penalty for paying it off early, and buyers repay the bonds… so it isn’t paid for by taxpayers.

The catch: Prop 37 is for new construction

This is the part people miss. Prop 37 money only goes toward a “qualified new home.” That means new construction, or an old commercial building turned into homes. And you have to be the first buyer.

So it won’t work on the house down the street that’s been there since 1985. If you’ve been looking at a new development near your school, your station or your hospital… that’s where this fits.

Who qualifies for Prop 37?

Who it’s for: lived in California a year, you’ll live in the home, household income under 2x the county median, a new home where you’re the first buyer, under the price cap.

  • You’ve lived in California at least a year
  • You’ll live in the home
  • Your household income is under twice the median for your county
  • The home is new, you’re the first buyer, and it’s under the county price cap… roughly $1 million to $1.5 million

Twice the median covers a lot of public employees. A teacher married to a nurse. A firefighter and a city planner. Two steady paychecks that make “too much” for most down payment help, and still can’t save 20% here. That’s who I think this was built for.

You don’t have to be a first-time buyer. But if you are, pay attention to this one.

When will Prop 37 loans be available?

Nobody knows yet. If someone gives you a date, they’re guessing.

Timeline: CalHFA sells the bonds, the rules get written, lenders get picked, loans open. Nobody has a date yet.

CalHFA still has to sell the bonds, write the rules, set the rate and term, and choose which lenders can offer it. I’m hoping it’s sometime in 2027. That’s a hope, not a date.

What California public employees can do now

  1. Get pre-approved. OfferReady gets your numbers lined up, so you’re ready when this opens… and ready for a builder now.
  2. Look at the help that’s here today. CalHFA already has down payment help, and it works on resale homes too.
  3. Talk to builders. Ask what’s going up near you, when it delivers, and whether they plan to work with Prop 37 buyers.
  4. Know your payment. Run a few prices through the mortgage calculator so you know what fits before you fall for a model home.

We’ll be watching for CalHFA’s rules and the lender list. When it opens, we’ll let you know.

Prop 37 questions from California public employees

Is Prop 37 a grant?

No. It’s a second mortgage you pay back. It’s fixed-rate, and the measure says there’s no penalty for paying it off early.

Can I use Prop 37 on a resale home?

No. It’s for new homes only… new construction, or a commercial building converted into homes, where you’re the first buyer.

Do I have to be a first-time home buyer?

The measure doesn’t require it. You do have to live in California for at least a year, live in the home, and be under the income and price limits.

Is CELP part of Prop 37?

No. Prop 37 is run by CalHFA. CELP is a mortgage program for California public employees operated by HappyDog. We’ll help you look at every option, including this one once CalHFA sets it up.
